What article 8.2 provides
Polluting or littering the environment by unloading or discharging waste outside waste disposal facilities or waste accumulation sites carries an administrative fine.
Note the wording: outside disposal facilities or accumulation sites. A sack left beside a bin compound rather than in the container falls within that description, and it is the commonest mistake.
- Citizens: 10,000 to 15,000 roubles
- Officials: 20,000 to 30,000 roubles
- Legal entities: 30,000 to 50,000 roubles
Throwing waste from a car
This is separately addressed in enforcement guidance and is also the commonest conduct. Throwing waste from a vehicle outside designated places falls under the same administrative liability.
The difference is that there is almost always a registration number. Which is exactly why noting the plate matters if you saw it.
Who inspects
Checks under article 8.2 are carried out by Rosprirodnadzor and regional state environmental supervision bodies.
In practice a domestic dump in a courtyard is resolved faster through the management company and the local administration, with supervisory bodies involved for significant volumes or hazardous waste.
Where to report it
- The local administration or district office, responsible for the upkeep of the territory
- The building management company, if the dump is on the grounds of a residential block
- The regional environmental supervision body or Rosprirodnadzor for large volumes and hazardous waste
- The police, if you saw who unloaded it or have a vehicle registration
- If anything is burning, smoking or leaking from containers, that is an emergency rather than a report
What a report should contain
- Exact location, ideally with coordinates. On a country track an address gives nothing
- Two photos: close enough to show the type of waste, and a wider one so the place can be found
- The type: construction waste, furniture, tyres, plant matter, drums, asbestos sheets
- Approximate volume, with something in frame for scale
- The date and, if you know, how long material has been brought there
- Visible traces of origin: dockets, labels, organisation names. There is no need to go through the waste itself
What not to do
- Do not clear it before reporting and photographing: the evidence disappears with the waste
- Do not touch drums, sealed sacks or sheets that might contain asbestos
- Do not follow or stop those unloading. Noting the plate and passing it on is enough
- Do not add your own. One spot attracts the next within days
Why a public record is needed
A cleared site returns to the same place with surprising regularity. These spots repeat for structural reasons: you can drive in, they are invisible at night, and the lawful site is far away.
One complaint produces one clearance. A history of the same place with dates and photographs is something else: it is the basis for requesting a barrier, a camera, a sign or a nearer site.
