Two levels, not one
This is the heart of it and the reason you find contradictory figures online. Dumping waste is not a single act.
Under article 154 of the Code of Petty Offences, throwing stones, rubbish, carrion or other filth onto land that is not yours carries a fine of up to 1,000 zł. That is a misdemeanour.
Article 183 of the Criminal Code covers waste that threatens the environment. That is a crime, punishable by imprisonment from 3 months to 5 years.
A bag by the bins and a tipper load of rubble in woodland are not the same thing, and the law does not treat them alike.
Where to report it
- The municipal guard (straż miejska or gminna) where one operates: the fastest route for a typical dump
- The police, especially if you saw who did it or have a registration number
- The Voivodeship Inspectorate for Environmental Protection for larger quantities, hazardous waste, or where a business is involved
- The gmina office, responsible for clearing municipal land
- 112 if anything is burning, smoking or leaking. That is a hazard, not a report
What a report should contain
- Exact location, ideally coordinates. In woodland or on a field track an address is useless
- Two photos: one close enough to show the type of waste, one wide enough to find the place again
- Type of waste: rubble, bulky items, tyres, green waste, drums, asbestos sheeting. The route and classification depend on it
- Approximate quantity, with something visible for scale
- The date, and how long the place has been used if you know
- Visible traces of origin: delivery notes, labels, company markings. Do not search through the waste
Asbestos and hazardous waste are a separate matter
Asbestos cement sheeting, chemical drums, waste oil and pesticide containers are not ordinary rubbish. Do not touch or move them.
Say explicitly in the report that you suspect asbestos or hazardous substances. It changes both the urgency and who handles it, and where waste threatens the environment article 183 of the Criminal Code comes into play.
What not to do
- Do not clear it before reporting. Good intentions destroy the evidence that obliged someone to act
- Do not add your own waste, however small. One dump attracts more within days
- Do not follow or photograph people to identify the culprit. That is the authorities' job and it exposes you
- Do not assume someone has already reported it. That is the commonest reason nobody has
Why a public trail is worth leaving
A cleared dump returns to the same place with surprising regularity. Such places repeat for structural reasons: vehicle access, no visibility after dark, a long way to the collection point.
A single report gets one clearance. A dated, photographed history of the same place is something else: it is the argument for a barrier, a camera trap, a sign or a nearer collection point. What is the penalty for dumping waste in Poland?
It depends on the classification. Throwing rubbish onto someone else's land carries a fine of up to 1,000 zł under article 154 of the Code of Petty Offences. Where waste threatens the environment it is a crime under article 183 of the Criminal Code, punishable by 3 months to 5 years imprisonment.
Where is best to report an illegal dump?
To the municipal guard, or where there is none, the police and the gmina office. For larger quantities or hazardous waste, also the voivodeship environmental protection inspectorate.
Can I report anonymously?
You can pass on the location without giving your details, but an identified report carries further procedurally. If in doubt, ask the body before filing.
Can I clear it myself?
Not before reporting and photographing it, or the evidence disappears. And do not touch drums, sealed sacks or sheeting that might contain asbestos at all.
