One bag is enough
Act no. 541/2020 Coll. on waste, in force since 1 January 2021, is uncompromising here. Waste may be deposited only at places designated by the municipality within its municipal waste management system.
There is no exception for "just one bag" or "it is right next to the container". Either the waste is in a designated place or it is not.
Under § 69(2), an individual commits an offence by unlawfully establishing a dump or depositing waste outside designated places, carrying a fine of up to 50,000 CZK.
The law does not contain the phrase everyone uses
This is a practical detail that trips up anyone trying to verify it in the statute.
The term "černá skládka" does not appear in the act. The statutory term is "unlawfully accumulated waste", governed by § 14.
So if you are looking for the exact wording, search for that term rather than the colloquial one.
Liability can reach the landowner
This surprises most people and it lands on those who did nothing wrong.
Responsibility does not rest only with whoever left the waste. The owner of land on which unlawfully accumulated waste appears has obligations of their own, including reporting the situation without undue delay to the municipal authority with extended competence.
So it is worth reporting a dump on your own land rather than quietly clearing it. Silence does not protect you; reporting does.
Who to report it to
- The municipal authority, or the municipality with extended competence, which handles the case
- The municipal police, particularly if you saw who left the waste or have a vehicle registration
- The Czech Environmental Inspectorate for larger quantities, hazardous waste, or where a company is involved
- 112 if anything is burning, smouldering or leaking. That is an incident, not a report
What a report should contain
- Exact location, ideally coordinates. On a forest track an address does not help
- Two photos: one close enough to show the type of waste, one wide enough to find the place
- The type: construction rubble, furniture, tyres, green waste, drums, asbestos cement boards. Competence and severity follow from it
- Approximate quantity, with something visible for scale
- The date, and how long the place has been used if you know
- Visible traces of origin: delivery notes, labels, company markings. Do not rummage through the waste
What not to do
- Do not clear it before reporting. It is well meant and it destroys the evidence
- Do not touch drums, sealed bags or boards that might contain asbestos
- Do not add anything on top, however little. One spot attracts more within days
- Do not rely on someone else having reported it. That is the commonest reason nobody has
Why a public trail helps
A cleared place becomes a dump again with surprising regularity. Such places repeat for structural reasons: you can drive there, it is not visible at night, the collection yard is far away.
One report brings one clearance. A dated, photographed history of the same place is something else: it is the argument for a barrier, a camera trap, a sign or a nearer collection yard. Is one bag beside a container really an illegal dump?
